1. Agreement
These Terms of Service ("Terms") govern your use of the bysajid.com website and the services provided by bySajid ("we", "us", "our"). By using this website or engaging our services, you agree to these Terms.
2. Our services
We provide digital marketing, SEO, web development, automation and related services. Specific deliverables, timelines, pricing and responsibilities for each engagement are set out in a written proposal or agreement. In the event of any conflict, the signed proposal/agreement prevails over these general Terms.
3. Client responsibilities
You agree to provide accurate information, grant necessary access to your accounts (websites, Google Business Profile, analytics, social media) required to deliver the services, and to respond to requests in a timely manner. Delays in providing access or feedback may affect timelines, for which we are not responsible.
4. Fees & payment
Fees are as stated in the proposal. Retainer services are billed monthly in advance unless agreed otherwise; project work may be billed in milestones. Payments are due as per the agreed schedule. Late payments may result in a pause of work until cleared.
5. No guaranteed results
Search engine rankings and digital marketing outcomes depend on many factors beyond our control, including search engine algorithms and your competition. We do not guarantee specific rankings, positions or results. We commit to our professional process, ethical tactics and honest reporting.
6. Intellectual property
Upon full payment, ownership of deliverables specifically created for you (website code, content, designs) transfers to you. We retain ownership of our tools, methodologies and pre-existing materials. We may showcase completed work in our portfolio unless you request otherwise.
7. Third-party platforms
Services involving third-party platforms (Google, Meta, WhatsApp, etc.) are subject to those platforms' terms and policies, which may change or suspend access independently of us. We are not liable for actions taken by these platforms.
8. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim arising out of or relating to our services is limited to the total fees paid by you for the specific service giving rise to the claim. We are not liable for indirect, incidental or consequential damages, or for loss of revenue, profits or data.
9. Termination
Either party may terminate an engagement with written notice as specified in the proposal. Retainers are month-to-month and may be cancelled with notice. Upon termination, you are responsible for fees earned or committed up to the effective date.
10. Governing law
These Terms are governed by the laws of India, and the courts of Mumbai, Maharashtra shall have exclusive jurisdiction over any disputes.
